1. Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Surefase Ltd. ("Surefase," "we," "us," or "our"), concerning your access to and use of the surefase.com website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

You agree that by accessing the Site and/or using our services, you have read, understood, and agree to be bound by all of these Terms of Use. If you do not agree with all of these Terms of Use, then you are expressly prohibited from using the Site and you must discontinue use immediately.

By using the Site, you represent and warrant that:

You are not a minor in the jurisdiction in which you reside
You will not access the Site through automated or non-human means
You will not use the Site for any illegal or unauthorized purpose
Your use of the Site will not violate any applicable law or regulation

4. API and Technology Services

If you access our shade-matching API or related technology services, additional terms may apply:

You agree to use our API only for legitimate business purposes
You will not attempt to reverse engineer or extract our proprietary algorithms
You are responsible for ensuring compliance with all applicable data protection laws
You will implement appropriate security measures when integrating our technology
Usage limits and quotas specified in your service agreement must be respected

5. Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. Prohibited activities include but are not limited to:

Systematically retrieving data or content without written permission

8. Governing Law

These Terms shall be governed by and defined following the laws of England and Wales. Surefase Ltd. and yourself irrevocably consent that the courts of England and Wales shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

9. Changes to Terms

We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms of Use, and you waive any right to receive specific notice of each such change.
